Amendments to the MASAK Compliance Program Regulation

1. Development and Investment Banks & Istanbul Settlement and Custody Bank Inc.

The amendments extend the scope of the compliance program to include development and investment banks, as well as Istanbul Settlement and Custody Bank Inc. These institutions must appoint a compliance officer and deputy by 31 October 2025 and establish compliance programs by 30 November 2025.

2. Online Betting and Gaming Agents

Entities conducting betting and gaming activities exclusively online, without physical premises or face-to-face interaction, have been included within the scope of compliance obligations. They are required to appoint compliance officers by 31 October 2025.

3. Appointment and Dismissal of Compliance Officers

A new restriction prevents the appointment of individuals as compliance officers or deputies in institutions they audited within the previous two years. Additionally, when a compliance officer or deputy is dismissed or resigns, the institution and the officer must notify MASAK within 10 days, providing the reasons.

4. Education and Licensing Requirements

As of 25 December 2025, compliance officers must hold a degree from a four-year higher education institution. However, those with at least six months of experience as compliance officers who do not meet this criterion may take the licensing exam for two years. Successful candidates will be granted a Compliance Officer License.

5. Entry into Force

Articles 2, 5, and 7 will enter into force on 25 December 2025. Other provisions took effect upon publication.
